Terms of Service

By using the C-LCA platform ("Service") you accept these Terms of Service ("Agreement"). Please read these terms carefully before using the platform.
1. Parties and Service Definition
This Agreement is between Marsala Yazılım A.Ş. ("Marsala", "we") and the natural or legal person using the platform ("User"). C-LCA is a life cycle assessment (LCA) and Environmental Product Declaration (EPD) authoring platform compliant with EN 15804+A2 and ISO 14040/44.
2. Account Creation and Responsibility
You must be at least 18 years old and have legal capacity to create an account. Account security (password, sessions) is the User's responsibility. You must immediately notify us of any unauthorised third-party access. Corporate account holders represent that they have authority to enter into this Agreement on behalf of their organisation.
3. License and Right to Use
Marsala grants the User the right to use the C-LCA platform for the duration of the Agreement. The license is non-exclusive, non-transferable and revocable. The User may not access the source code, reverse engineer, copy or create derivative works of the software.
4. User Obligations
The User shall (a) comply with applicable laws, (b) provide accurate and up-to-date information, (c) not abuse the system (DDoS, malicious software, unauthorised access), (d) not infringe the rights of others, (e) not share trade-secret information without authorisation. In case of breach, Marsala reserves the right to suspend or terminate the account.
5. Data and Content Ownership
LCA data, project information and calculation results uploaded by the User to the platform belong to the User. Marsala uses this data only to provide the service and does not claim ownership or commercial rights. The platform itself (code, design, brand) is the intellectual property of Marsala.
6. Third-Party Data
The platform integrates with the ecoinvent v3.12 inventory database. Use of ecoinvent data is subject to ecoinvent Association's license terms. The User has the right to use ecoinvent data within the platform; exporting or reselling the data is prohibited.
7. Pricing and Billing
Service fees are charged according to Marsala's plans and pricing. A 50% discounted package is offered for academic institutions. Invoices are issued electronically. For annual payments, refunds may be requested within 14 days from the payment date.
8. Service Level (SLA)
Marsala targets 99.9% annual uptime. Planned maintenance windows are announced at least 48 hours in advance. Service credits may be granted for unplanned outages. Marsala's maximum liability under SLA is limited to the subscription fee for the month in which the breach occurred.
9. Limitation of Liability
Marsala does not warrant uninterrupted or error-free operation of the platform. LCA calculation results depend on data entered by the User; the User is responsible for the accuracy of inputs. Marsala's total liability is limited to the subscription fees paid in the previous 12 months. Indirect damages (lost profit, business interruption, etc.) are excluded.
10. Termination
The User may close their account at any time. Marsala may terminate the Agreement with 30 days' notice for breach, payment delay or legal obligation. In emergency situations (legal/security) suspension may occur without notice. Data deletion/return procedure after termination is described in the Privacy Policy.
11. Governing Law and Jurisdiction
This Agreement is governed by the laws of the Republic of Türkiye. The İzmir Courts and Enforcement Offices have exclusive jurisdiction over disputes. Consumer users retain the right to bring proceedings in their place of residence. Arbitration/mediation may be agreed upon by the parties.
12. General Provisions
If any provision of this Agreement is held invalid, the remaining provisions remain in effect. This Agreement, together with any addenda and notices, constitutes the entire agreement between the parties. Marsala reserves the right to modify the terms; material changes are notified 30 days in advance.
